By accessing or using Herp Ledger (the "Service"), including our website, web application, and any related services (collectively, "Herp Ledger"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Herp Ledger reserves the right to modify these Terms at any time. Updates will be posted on this page with a revised "Last Updated" date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

1. Eligibility

• You must be at least 13 years old to use the Service.
• If you are under 18, you represent that you have permission from a parent or legal guardian.
• You must be a human. Accounts registered by bots or automated methods are not permitted.

2. Account Registration & Security

• You must provide accurate and complete information during registration.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You may not share your login credentials with others unless your subscription plan specifically permits multi-user access.
• Herp Ledger is not liable for losses resulting from unauthorized access to your account.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Violate any applicable local, state, national, or international law.
• Upload malicious code, viruses, or harmful software.
• Attempt to reverse engineer, hack, or disrupt the Service.
• Upload content that is unlawful, threatening, abusive, defamatory, obscene, or infringes on intellectual property rights.
• Use the Service to transmit spam or unsolicited communications.

We reserve the right to suspend or terminate accounts that violate these rules.

4. User Content & Data Ownership

• You retain full ownership of the reptile records, breeding logs, images, notes, and other content you upload ("User Content").
• By using the Service, you grant Herp Ledger a limited license to host, store, and process your User Content solely to provide the Service.
• We do not claim ownership over your data.
• You are solely responsible for the accuracy and legality of your content.
• Herp Ledger may remove content that violates these Terms.

5. Subscriptions, Billing & Payments

• Certain features require a paid subscription.
• Subscriptions are billed in advance on a monthly or annual basis.
• All payments are non-refundable unless required by law.
• If you cancel your subscription, you will retain access until the end of the current billing cycle.
• Downgrading may result in loss of certain features, capacity, or cloud storage access.
• If payment fails, we may suspend your account after a reasonable grace period.
• You are responsible for any taxes associated with your subscription.

6. Free Accounts

Free accounts may have limitations including:

• Limited number of tracked animals
• Reduced storage
• Restricted features

Herp Ledger reserves the right to modify free tier limitations at any time.

7. Cancellation & Termination

• You may cancel your subscription at any time through your account settings.
• Upon cancellation, your account may revert to a free plan (if available) or be scheduled for deletion.
• If your account is deleted, your data may be permanently removed and unrecoverable.
• Herp Ledger may suspend or terminate your account for violation of these Terms or misuse of the Service.

8. Data & Backup Disclaimer

While we implement reasonable safeguards to protect user data:

• The Service is provided "as is" and "as available."
• We do not guarantee uninterrupted, secure, or error-free operation.
• You are responsible for maintaining backups of critical data.
• Herp Ledger is not liable for data loss, corruption, or accidental deletion.

9. Intellectual Property

• The Herp Ledger name, logo, software, design, and underlying code are the exclusive property of Herp Ledger.
• You may not copy, reproduce, distribute, or modify any part of the Service without written permission.
• All trademarks and branding remain the property of Herp Ledger.

10. Third-Party Services

Herp Ledger may use third-party providers (such as hosting, payment processors, or cloud storage providers). We are not responsible for third-party service interruptions or policies.

11. Limitation of Liability

To the maximum extent permitted by law:

• Herp Ledger shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
• Loss of profits
• Loss of data
• Loss of goodwill
• Business interruption

Your use of the Service is at your sole risk.

12. No Veterinary or Professional Advice

Herp Ledger is a tracking and record-keeping platform only. It does not provide veterinary, medical, or professional husbandry advice. Users remain fully responsible for the care and welfare of their animals.

13. Governing Law

These Terms shall be governed by the laws of the applicable jurisdiction, without regard to conflict of law principles.

14. Changes to the Service

Herp Ledger reserves the right to modify, suspend, or discontinue any part of the Service at any time without liability.

15. Entire Agreement

These Terms constitute the entire agreement between you and Herp Ledger regarding use of the Service and supersede all prior agreements.
